These Terms of Service ("Terms") are an agreement between you and The Pet WellBeing Company Pty Ltd, Australia ("we", "us"), which operates VizWhale. They apply when you use vizwhale.com or the VizWhale app (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. The Service
VizWhale is an analytics dashboard that shows creators their performance on supported social platforms (currently Instagram, Facebook and YouTube). The Service is currently an invite-only beta. During the beta, features may change, be limited, or be removed, and the Service may sometimes be unavailable.
2. Eligibility and your account
- You must be at least 16 years old and able to form a binding agreement.
- You are responsible for your account and for keeping your sign-in details secure. Tell us straight away at support@vizwhale.com if you think your account has been misused.
- Only connect social accounts that you own or are authorised to manage.
3. Connected platforms
When you connect a social account, you authorise VizWhale to read data from that platform on your behalf, using read-only permissions. Your use of each platform remains subject to that platform's own terms. By connecting YouTube, you agree to be bound by the YouTube Terms of Service and acknowledge the Google Privacy Policy. Use of Instagram and Facebook data is subject to Meta's terms. VizWhale is not affiliated with or endorsed by Meta, Google or YouTube.
Platforms can change or limit what data they make available. Some metrics may be delayed, estimated, incomplete or unavailable, and we can't guarantee that VizWhale's figures will exactly match what each platform shows.
4. Price
The Service is free during the beta. If we introduce paid plans later, we will tell you in advance, and you will not be charged unless you choose a paid plan.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to infringe anyone's rights;
- connect accounts you don't have permission to manage;
- try to access other users' data, or probe, scrape, overload or disrupt the Service;
- copy, resell, or reverse engineer the Service, except where the law allows; or
- use the Service in a way that breaks the terms of any connected platform.
6. Your content and data
You keep all rights to your content and data. You give us permission to collect, store and process it only as needed to provide the Service to you, as described in our Privacy Policy. You can disconnect accounts or delete your data at any time; see Data Deletion.
7. Our intellectual property
The Service, including the VizWhale name, logo, whale mascot, design and software, belongs to us. These Terms don't give you any right to use our branding without our permission.
8. Feedback
We love feedback, especially during the beta. If you send us ideas or suggestions, we may use them to improve VizWhale without owing you anything.
9. Suspension and ending your use
You can stop using VizWhale and delete your account at any time. We may suspend or end your access if you break these Terms, if a connected platform requires it, or if we end the beta or the Service. Where reasonable, we will give you notice and a chance to export your data.
10. Disclaimers
The Service is provided "as is" and "as available". Analytics and insights are for information only and are not professional, financial or marketing advice. To the extent the law allows, we don't make any promises that the Service will be error-free, uninterrupted or that figures will be complete or accurate.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.
11. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, followers or business opportunities. Because the Service is free during the beta, our total liability to you for any claim relating to the Service is limited to AUD $100. Where liability for a consumer guarantee can be limited, our liability is limited to supplying the Service again or paying the cost of having it supplied again.
12. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above and, for significant changes, let you know by email or in the app. If you keep using the Service after changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.
